Terms of Use
Article 1 (Members)
1. A "Member" means an individual who applies for membership in accordance with the procedures prescribed by the Company after agreeing to these Terms.
2. "Member Information" means information concerning attributes disclosed by a Member to the Company, as well as records relating to transactions conducted by the Member.
3. These Terms apply to all Members and shall be observed both during the registration procedure and after registration.
Article 2 (Registration)
1. Eligibility for Membership
Customers who apply for membership in accordance with the prescribed procedures after agreeing to these Terms shall obtain membership status upon completion of the prescribed registration procedure. Membership registration must be completed by the person who will become the Member. Registration by proxy is not permitted. The Company may refuse membership applications from persons whose membership has been revoked in the past or from persons otherwise deemed inappropriate by the Company.
2. Entry of Member Information
When completing the membership registration procedure, please read the instructions carefully and enter the required information accurately in the designated form. Certain special symbols, old-style characters, Roman numerals, and similar characters may not be used when registering Member Information. If such characters are entered, the Company may replace them.
3. Password Management
(1) Passwords may be used only by the Member and may not be transferred, lent, or otherwise provided to any third party.
(2) Members shall manage their passwords at their own responsibility, including changing them regularly so that they do not become known to others.
(3) Any expression of intent made to the Company using a password shall be deemed to be the expression of intent of the Member, and all payments and other obligations arising therefrom shall be borne by the Member.
Article 3 (Changes)
1. If there is any change to information previously provided to the Company, such as name or address, the Member shall promptly notify the Company.
2. The Company shall not be liable for any damages arising from a Member's failure to update registration information. Even where registration information has been updated, transactions that have already been processed prior to such update will be carried out based on the information registered before the change.
Article 4 (Withdrawal)
If a Member wishes to withdraw, the Member must complete the prescribed withdrawal procedure personally. Withdrawal shall become effective after completion of the prescribed procedure.
Article 5 (Loss of Membership and Indemnification)
1. The Company may revoke membership if a Member makes a false statement when applying for membership, fails to fulfill payment obligations arising from mail-order transactions, or otherwise is deemed inappropriate as a Member by the Company.
2. If a Member engages in any of the following acts, the Member shall be liable to compensate the Company for any damages thereby incurred by the Company.
(1) Unauthorized use of membership numbers or passwords
(2) Interfering with the Company's business by accessing this website and falsifying information, transmitting harmful computer programs, or engaging in similar acts
(3) Infringing intellectual property rights relating to jewelry handled by the Company
(4) Any other act in violation of these Terms
Article 6 (Handling of Member Information)
1. As a general rule, the Company will not disclose Member Information to any third party without the Member's prior consent. However, the Company may disclose Member Information and other customer information without such prior consent in the following cases:
(1) Where disclosure is required by law
(2) Where the Company determines that disclosure is necessary to protect its rights, interests, reputation, or similar matters
2. Member Information shall be managed by the Company in accordance with its "Privacy Policy." The Company may use Member Information for the purpose of providing services to Members, improving service content, promoting the use of services, and ensuring the sound and smooth operation of services.
3. The Company may provide Members with information, including advertisements, by email newsletter or other means. If a Member does not wish to receive such information, the Company will stop providing it upon notice in accordance with the Company's prescribed procedures; provided, however, that information necessary for the operation of the Service cannot be suspended at the Member's request.
Article 7 (Prohibited Acts)
In using the Service, Members are prohibited from engaging in any of the following acts:
1. Violating laws, these Terms, notes regarding use of the Service, notes regarding shopping on the Service, or any other applicable rules
2. Infringing or harming the rights, interests, honor, or reputation of the Company or any third party
3. Engaging in acts that may adversely affect minors physically or mentally, or otherwise offend public order and morals
4. Engaging in acts that cause nuisance, discomfort, or harm to other users or third parties
5. Entering false information
6. Transmitting or posting harmful computer programs, emails, or similar content
7. Gaining unauthorized access to the Company's servers or other computers
8. Lending or transferring passwords to third parties, or sharing them with third parties
9. Any other act deemed inappropriate by the Company
Article 8 (Interruption, Suspension, etc. of the Service)
1. In order to maintain the Service in a good operating condition, the Company may suspend all or part of the Service without prior notice in any of the following cases:
(1) Where necessary for periodic or emergency system maintenance
(2) Where the system is under excessive load
(3) Where operation of the system becomes difficult due to fire, power outage, interference by a third party, or similar causes
(4) Where the Company otherwise determines that suspension of the system is unavoidable
Article 9 (Modification or Discontinuation of the Service)
The Company may, at its discretion, change or discontinue all or part of the Service at any time without prior notice.
Article 10 (Disclaimer)
1. The Company shall not be liable for any damages incurred by Members in connection with the Service due to interruption, delay, suspension, loss of data, unauthorized access to data, or any other problems arising from communication lines, computers, or similar causes.
2. The Company does not guarantee that emails, content, or other materials sent from the Company's webpages, servers, or domains are free from harmful elements such as computer viruses.
3. The Company shall not be liable for any damages arising from a Member's violation of these Terms or related rules.
Article 11 (Amendment of These Terms)
The Company may amend these Terms at its discretion and may also establish supplementary rules that supplement these Terms. Any amendment or supplement shall take effect when the revised Terms or supplementary rules are posted on the Company's designated website. In such case, Members shall comply with the revised Terms and supplementary rules.
Article 12 (Governing Law and Jurisdiction)
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the Company's head office as the court of first instance.
